A Trademark is designed to protect your intellectual property, products and designs and prevent these from being exploited through plagiarism and potentially harmed through misuse. A Trademark also serves to distinguish your goods or services from competitors in your market.
The most important part of any Trademark application is the specification of goods or services. In terms of Section 11(1) of the Trademark Act (South African Trademarks Act No. 194 of 1993), a Trademark must be registered in respect of goods or services falling into a particular class. All goods and services fall into one of 45 classes. These classes are subdivided in thirty-four (34) classes for goods; and eleven (11) for services. We will assist you to ensure you choose the correct class(es) to ensure protection you need.
OUR PROCESS…
Phase One: Special Search.
Our first step determines whether you should proceed with the Trademark application or rather adjust any details to ensure the adequate differentiation of your product, brand or service. This phase takes between 6 and 8 weeks to conclude and ensures that your application has the greatest likelihood of being approved by the Trademark Registrar.
If you need to register within more than one Trademark Class, additional costs do apply. A ‘class’ is a specific service / product category and there are thirty-four (34) classes for goods; and eleven (11) for services.
Phase Two: Application for Trade Mark registration.
After the first phase has been completed, we submit your Trademark Application to the Trademark Register who will confirm that your application passes all the required criteria

Trademark Registration Requirements
A Trademark is registrable if your goods or services can be easily distinguished from what is already available on the market. It should not be anything that would be considered customary in your industry or trade, and should not designate the kind, quality, quantity, value, production or delivery of your product or services. Further, a Trademark should never be deceptive, offensive or contrary to what are considered good moral standards.
A Trademark is not registrable if it includes any recognised emblem, coat of arms or national flags nor can it include reference to any commonly used terms and concepts. For example, the word ‘Milk’ cannot be used as a Trademark for any milk product.
Trademark Renewal
Your Trademark registration needs to be renewed every 10 years. If you do ensure that your Trademark is renewed at the required time, your rights to that Trademark can continue indefinitely.
